> 1. Introduction

These Terms of Service ("Terms") govern your use of the Cutio browser extension and related services (collectively, the "Service") operated by Dmitrii Brolnitskii ("we," "us," or "our"). By installing the extension or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. The contract for use of the Service is formed upon completion of account registration.

> 2. Description of Service

Cutio is a browser extension that uses artificial intelligence to detect and skip sponsor segments in YouTube videos. The extension analyzes publicly available video transcripts using large language models (LLMs) and overlays skip controls on YouTube pages. Cutio is an independent product and is not affiliated with, endorsed by, or sponsored by YouTube, Google LLC, or Alphabet Inc.

> 3. Eligibility

You must be at least 13 years old to use the Service. By using Cutio, you represent that you meet this age requirement. Using the Service requires a Google account, which is subject to Google's own age requirements and terms. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

> 4. Account Registration

To use Cutio, you must sign in with your Google account via OAuth. You agree to provide accurate information and to keep your account secure. You are responsible for all activity under your account. Each individual may maintain only one account.

Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

> 5. Free and Paid Plans

Cutio offers a free tier with limited monthly AI token usage (approximately 12–15 video analyses per month, depending on video length) and paid subscription plans — Premium ($4.99/month) and Premium Plus ($9.99/month) — with higher token allowances and additional features. Token usage resets on the 1st of each calendar month (UTC). Unused tokens do not roll over to subsequent months.

We reserve the right to modify plan features, token limits, and pricing at any time. Existing subscribers will be notified of material changes at least 30 days in advance via email. Changes to paid plans take effect at the start of the next billing cycle.

> 6. Subscription and Billing

All subscription payments are processed by Paddle.com Market Limited (for customers outside the United States) and Paddle.com Inc. (for US customers), acting as our Merchant of Record. This means Paddle is the legal seller of the subscription and handles all billing, invoicing, sales tax, and currency conversion. Your agreement for the use of the Cutio Service itself remains with us; when you purchase a subscription, your payment agreement is separately with Paddle, subject to Paddle's Terms of Use and Paddle's Privacy Policy.

Subscriptions are billed monthly, starting from the date of purchase, and automatically renew at the end of each billing period unless canceled before the renewal date. If you cancel or downgrade from a paid plan to the free tier, you retain paid features until the end of your current billing period. If a payment fails, we may suspend access to premium features until payment is resolved. We do not store your credit card or payment details — all payment information is collected and managed by Paddle. For details on refunds, cancellations, and downgrades, please see our Refund Policy.

> 7. Refund Policy

Our full Refund Policy is available at cutio.dev/refund. It describes refund eligibility, the request process, processing timeframes, and cancellation terms.

> 8. User-Provided API Keys

Cutio allows you to provide your own API keys for third-party AI services (Google Gemini, OpenRouter). If you choose to use this feature, you are solely responsible for your relationship with the third-party provider, including compliance with their terms of service, usage policies, and billing. Your API keys are encrypted at rest in our database using AES-256-GCM and are never stored in plaintext. However, by providing your key, you acknowledge the inherent risks of transmitting credentials to a third-party service. You may remove your key at any time. We are not responsible for any charges incurred on your third-party AI provider account as a result of using Cutio, nor do we guarantee the availability or performance of third-party AI providers. You must not provide API keys that are stolen, unauthorized, or obtained in violation of any third party's terms.

> 9. AI-Powered Features

Cutio uses artificial intelligence and large language models to analyze video transcripts and identify potential sponsor segments. You acknowledge and agree that: (a) AI-generated results are approximations and may be inaccurate, incomplete, or miss segments entirely; (b) Cutio may incorrectly identify non-sponsored content as sponsored (false positives) or fail to detect sponsored segments (false negatives); (c) the accuracy of results depends on factors outside our control, including transcript quality, video language, and AI model behavior; (d) you are solely responsible for verifying any actions taken based on Cutio's output; and (e) we do not guarantee any specific level of accuracy, uptime, or performance of the AI features.

> 10. YouTube and Third-Party Services

Your use of YouTube through or alongside Cutio remains subject to YouTube's Terms of Service. Cutio does not grant you any rights to YouTube content beyond what YouTube itself permits. Cutio accesses publicly available video transcript and subtitle data to perform its analysis. Cutio does not download, copy, store, or redistribute any YouTube video or audio content, and does not circumvent any access controls or technical protection measures. We cannot guarantee continued compatibility with YouTube — changes to YouTube's platform, policies, or technical infrastructure may affect or disable Cutio's functionality at any time, and we are not liable for any loss of functionality caused by third-party changes.

> 11. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse engineer, decompile, or disassemble the extension or any part of the Service; (c) use automated tools to scrape, overload, or abuse the Service; (d) resell, redistribute, or sublicense access to the Service; (e) interfere with or disrupt the Service or its infrastructure; (f) circumvent rate limits, token quotas, or other usage restrictions; or (g) create multiple accounts to evade usage limits.

We reserve the right to suspend or terminate your access immediately and without notice if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users.

> 12. Intellectual Property

Cutio and its original content, features, and functionality are owned by us and are protected by applicable intellectual property laws. The extension is licensed to you for personal, non-commercial use. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent. All feedback, suggestions, or ideas you submit about the Service may be used by us without obligation to you.

> 13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you acknowledge the data processing practices described in the Privacy Policy.

> 14. Account Deletion

You may delete your account at any time through the extension settings. Upon deletion, your personal data is permanently anonymized or erased as described in our Privacy Policy. For details on what data is retained or deleted, please refer to the Privacy Policy.

> 15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated results. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any results will be accurate or reliable. This disclaimer does not affect any statutory warranty rights you may have under applicable consumer protection law.

> 16. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to us (via Paddle) in the twelve (12) months preceding the claim. If you have not made any payments, our liability shall not exceed ten US dollars ($10.00).

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) intentional misconduct or gross negligence; (d) breach of essential contractual obligations (in which case liability is limited to foreseeable, typically occurring damages); or (e) any other liability that cannot be excluded or limited under applicable law.

> 17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of: (a) your willful or negligent violation of these Terms; (b) your violation of any third party's rights, including YouTube's Terms of Service or any AI provider's terms; or (c) your use of the BYOK feature, including any third-party charges or disputes related to your API keys. This indemnification obligation does not apply to the extent that the claim arises from our own fault or negligence.

> 18. Service Modifications and Discontinuation

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time. For modifications that materially affect your use of the Service, we will make reasonable efforts to provide advance notice via email. For a complete discontinuation of the Service, we will provide at least 30 days' advance notice to active subscribers via email. To the maximum extent permitted by applicable law, we shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

> 19. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and provide at least 30 days' advance notice via email before the changes take effect. If you do not agree to the revised Terms, you may terminate your account and stop using the Service before the changes take effect; termination in this case will not incur any penalty. If you continue to use the Service after the updated Terms take effect, you will be deemed to have accepted the changes. This does not affect your right to terminate at any time under applicable law.

> 20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Germany.

> 21. General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and us regarding the Service, superseding any prior agreements.
